LAWFUEL – The Law Newswire – The New Zealand Police have made their recommendation about whether multiple murder accused David Bain should face a retrial or not and the decision is now with the Solicitor General, Otago Daily Times reports.
Detective Senior Sergeant Kallum Croudis, the Dunedin officer in charge of the Bain file would not say whether or not police had recommended for Bain to return to court to face another trial for the murders of his parents and three siblings in their Dunedin home in 1994.
Police spent the last three weeks revisiting their evidence, after Bain’s original conviction for the murder of his father, mother, two sisters and brother were quashed by the Privy Council last month.
Bain, who was 23 at the time of the killings, has maintained his innocence throughout his 13-year imprisonment.
The London-based Law Lords ordered a retrial, ruling a substantial miscarriage of justice had taken place.
