The Federal Rule of Evidence 502, which provides protection to parties with privileged information who unintentionally disclose privileged material, will be the subject of a panel discussion in Houston, Texas on October 29, 2010, featuring Fordham Law Professor Daniel Capra, principal author of Rule 502, and Hon. Lee Hyman Rosenthal, who steered it through Congress and chairs the Judicial Conference Standing Committee on Rules of Practice and Procedure. Kenneth Gary, associate publisher of the National Law Journal and Legal Times, will moderate.
In an effort to reduce litigation costs typically arising in the process of privilege review and production, Congress signed Rule 502 into law roughly two years ago. Panelists will examine the effectiveness of the rule thus far, what parties can do to maximize their protection under the rule, and potential risks left unaddressed.
