DENVER – LawFuel.com – Bobby Ulysses Brown, age 27, of Colorado Springs, Colorado, a senior leader of the Sureno street gang, was sentenced last week by U.S. District Court Judge Philip A. Brimmer to serve 64 months (just over 5 years) in federal prison for being a felon in possession of a firearm, United States Attorney David Gaouette and ATF Special Agent in Charge Richard Chase announced. Following his prison sentence, Brown was ordered to serve 3 years on supervised release. Brown, who appeared at the sentencing hearing in custody, was remanded.
Bobby Ulysses Brown was indicted by a federal grand jury in Denver on March 26, 2009. He pled guilty before Judge Brimmer on June 5, 2009. He was sentenced on October 6, 2009.
According to the stipulated facts contained in the plea agreement, on February 25, 2009, the Colorado Springs Police Department Tactical Enforcement Unit executed a search warrant at a residence in the 4300 block of Hawks Lookout Lane. As officers served the warrant, numerous individuals were contacted outside the residence. One of these individuals fled into the residence upon seeing officers arrive. An officer had positioned himself to the rear of the residence and observed the defendant attempting to flee through a bedroom window. The officer ordered the defendant to stop. In response, the defendant retreated back into the bedroom. Officers from the front of the residence ordered the defendant out of the bedroom, and he complied.
A search of the residence resulted in the seizure of a loaded firearm, methamphetamine, marijuana, plastic baggies, and U.S. currency. The firearm recovered was a Glock, .45 caliber, semi-automatic pistol. It was found on the bed. The pistol had an extended capacity magazine containing 15 live rounds of ammunition. On the bed next to the pistol was a bag containing 12.6 grams of methamphetamine, and 2.2 grams of marijuana. Between the mattresses, officers recovered another bag containing 8.5 grams of methamphetamine. In the closet, officers recovered a box containing 28 rounds of live .45 ammunition, and the original clip to the firearm containing 12 rounds of .45 caliber ammunition, and the original clip to the firearm containing 12 rounds of .45 caliber ammunition.
Brown possessed the firearm while being a convicted felon, which is prohibited under federal law. Brown had the following convictions:
* Possession of a Scheduled II Controlled Substance on or about June 9, 2005, in El Paso County.
* Theft on or about June 9, 2005, in El Paso County.
* Motor vehicle theft-aggravated on or about June 9, 2005, in El Paso County.
“Thanks to the efforts of the Colorado Springs Police Department and the ATF, another drug dealing gang member has been incarcerated for his criminal conduct,” said U.S. Attorney David Gaouette.
“Convicted felons in possession of drugs and guns are a target for ATF and our Law Enforcement partners,” said ATF Special Agent in Charge Richard Chase. “Our communities will be much safer with this gang leader behind bars.”
The Brown case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
Brown was prosecuted by Assistant U.S. Attorney Kurt Bohn.
