LAWFUEL – The Legal Newswire – SAN JOSE – United States Attorney Scott N. Schools announced that Francisco Castro-Salcedo was sentenced yesterday by U.S. District Court Judge Jeremy Fogel to 51 months in prison, followed by a three year term of supervised release. This sentence was a result of an investigation by U.S. Immigration and Customs Enforcement.
Mr. Castro-Salcedo, 34, a Mexican citizen, pleaded guilty on May 30, 2007 to one count of Illegal Reentry into the United States, in violation of Title 8, United States Code, Section 1326. According to his indictment, Castro-Salcedo was found in the Northern District of California in June 2006 after having been previously deported in 2001. The indictment stated that Castro-Salcedo had illegally returned to the United States without having received permission to do so from the Attorney General of the United States or the Secretary of Homeland Security.
Castro-Salcedo’s Illegal Reentry conviction followed a prior felony conviction in 1997 for Lewd/Lascivious Acts Upon a Child Under 14 for which he received a sentence of six years imprisonment. That 1997 conviction involved Castro-Salcedo sexually assaulting on two occasions a three year old boy whom his mother was babysitting.
Joseph Fazioli is the Assistant United States Attorney who prosecuted the case with the assistance of Legal Assistant Susan Kreider. This sentence was a result of an investigation by U.S. Immigration and Customs Enforcement.
