LAWFUEL – A federal judge has overturned a decision that doubled damages in the patent infringement lawsuit brought by Broadcom Corp against Qualcomm Inc. A judge awarded Broadcom nearly $40 million in August, following a finding that the patent infringements were wilful.
Broadcom has reportedly chosen to accept $19.6 million in patent infringement damages and will not seek a new trial.
The judge vacated a jury’s finding of ‘willfulness’ in the patent case and ruled that the awarding of enhanced damages and attorneys’ fees against Qualcomm, which were based on a jury’s findings of willful infringement, cannot stand, Qualcomm said. The patents relate to video compression and other cellular technology.
