PHOENIX (LAWFUEL) – A federal grand jury in Phoenix returned a 1-count indictment yesterday against Jeraldine Ann Kay, 45, of Mesa, Ariz., charging her with Theft by an Officer or Employee of a Gaming Establishment on Indian Lands.
The indictment alleges that from September 2 through September 16, 2008, Kay stole in excess of $1,000 while working as a cashier at the Fort McDowell Casino gift shop. Kay has been summoned to appear in federal court but no date has been set for that appearance.
A conviction for Theft by Officers or Employees of Gaming Establishment on Indian Lands carries a maximum penalty of 20 years in federal prison, a $1,000,000 fine or both. In determining an actual sentence, the assigned federal judge will consult the U.S. Sentencing Guidelines, which provide appropriate sentencing ranges. The judge, however, is not bound by those guidelines in determining a sentence.
An indictment is simply the method by which a person is charged with criminal activity and raises no inference of guilt. An individual is presumed innocent until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.
The investigation preceding the indictment was conducted by the Fort McDowell Police Department. The prosecution is being handled by Mark Brnovich, Assistant U.S. Attorney, District of Arizona, Phoenix.
