Weil Gotshal litigators obtained an important victory for long time client Johnson & Johnson, securing a complete defense verdict on behalf of the company in an action involving allegations of antitrust violations and with potential damages of $54 million before trebling. Plaintiff Applied Medical Corporation alleged that Johnson & Johnson used its position as the market leader in sutures to achieve a monopoly position in the endomechanical market. The case, which resulted in a five-week trial that culminated in three days of jury deliberations, was the first of three competition actions and a series of class actions against Johnson & Johnson.
